Update: Los Angeles District Attorney George Gascón is planning to make a decision about the fate of the Menendez brothers and their possible early release very soon

There’s actually two different camps in my office,” Gascón told CNN (via Deadline). “I have a group of people, including some that were involved in the original trial, that are adamant that they should spend the rest of their life in prison and that they were not molested. I have other people in the office that believe actually, that they probably were molested and that they deserve to have some relief… I plan to have a decision by the end of this week.

Earlier this month, Monsters creator Ryan Murphy predicted that Erik and Lyle Menendez could be released by Christmas, and it may actually happen. Los Angeles District Attorney George Gascón is said to be mulling an early release for the Menendez brothers as he seeks re-election.

Given the totality of the circumstances, I don’t think they deserve to be in prison until they die,” Gascón told ABC News Nightline co-anchor Juju Chang in a recent interview. In a statement to Deadline, Chang said, “He is tipping his hand to the totality of evidence that his office has been considering. He also added that there are deep differences of opinion about this case within the DA’s office and that this is not a decision he is taking lightly.” The full interview, IMPACT x Nightline: Menendez Brothers: Monsters or Victims?, will stream on Hulu on October 17th.

A number of Menendez family members gathered outside Clara Shortridge Foltz Criminal Justice Center today to demand leniency for the brothers. One of the new pieces of evidence is a letter allegedly written by Erik Menendez to his cousin Andy Cano eight months before the murders. “I’ve been trying to avoid dad. It’s still happening Andy but it’s worse for me now. I can’t explain it. He’s so overweight that I just can’t stand to see him. I never know when it’s going to happen and it’s driving me crazy,” said Erik in the letter.

Thanks to Monsters: The Lyle and Erik Menendez Story and the true-crime documentary The Menendez Brothers, interest in the case has returned to heights not seen since their highly publicized trial in the ’90s. A new court hearing has been set for November 29th, which will determine whether the Menendez brothers should be resentenced in light of new evidence.

We have been given evidence. We have been given a photocopy of a letter that allegedly was sent by one of the brothers to another family member talking about him being the victim of molestation. We’ve also got evidence that was provided by the defense, by his lawyers, that one of the members of the Menudo band alleged that he was molested by the father. None of this information has been confirmed,” Gascón announced on October 3rd. “We are not at this point ready to say that we either believe or do not believe that information, but we’re here to tell you is that we have a moral and an ethical obligation to review what is being presented to us and make a determination based on a resentencing side, whether they deserve to be resentenced, even though they were clearly the murderers, because they have been in prison for 35 years and they have paid back their dues to society, or whether behaviors is appropriate. If there was evidence that was not presented to the court at that time, and had that evidence been presented, perhaps a jury would have come to a different conclusion.

Monsters: The Lyle and Erik Menendez Story has proven to be another success for Ryan Murphy, and work on the third season of the Monsters series is already underway. It was announced last month that Charlie Hunnam would star in Monsters season 3 as Ed Gein, and Netflix has revealed that Laurie Metcalf, Tom Hollander, and Olivia Williams will be joining him.

Laurie Metcalf will play Augusta Wilhelmine Gein, Ed Gein’s mother, while Tom Hollander will play iconic director Alfred Hitchcock, and Olivia Williams will play Alma Reville, Alfred’s wife.

Ed Gein became infamous in the 1950s when authorities discovered that he had killed multiple people as well as dug up graves from a nearby cemetery to craft a variety of household items and clothing from the remains. His case served as an inspiration for many notable horror villains, including Leatherface in The Texas Chain Saw Massacre, Buffalo Bill in The Silence of the Lambs, and, of course, Norman Bates in Psycho.

As I mentioned above, the second season of Monsters has been a success for Netflix, but it hasn’t been without controversy. One of the subjects, Erik Menendez, took to social media (through his wife Tammi) to slam Monsters co-creator Ryan Murphy for including “ruinous character portrayals” of both him and his brother. Murphy hit back, saying that they should be sending him flowers for giving them so much attention again. “I’ll tell you my thoughts about the Menendez brothers. The Menendez brothers should be sending me flowers. They haven’t had so much attention in 30 years. And it’s gotten the attention of not only this country, but all over the world. There’s sort of an outpouring of interest in their lives and in the case,” Murphy said. “I know for a fact that many people have offered to help them because of the interest of my show and what we did. There is no world that we live in where the Menendez brothers or their wives or lawyers would say, ‘You know what, that was a wonderful, accurate depiction of our clients.’ That was never going to happen, and I wasn’t interested in that happening.

The Menendez brothers have been granted a new court hearing which will determine whether they should be resentenced in light of new evidence. Murphy said he believes the brothers could be released by Christmas and is considering the possibility of filming one or two more episodes to serve as an epilogue.

The famous double homicide case involving the Menendez brothers is weaving a tangled web with Ryan Murphy’s show Monsters: The Lyle and Erik Menendez Story bringing dialogue and debate into the circumstances surrounding the case. Murphy was quoted as saying, “I know for a fact that many people have offered to help them because of the interest of my show and what we did.” And it was recently announced that the brothers, who were first tried in the 90s, will be given another court hearing in light of new evidence. Los Angeles District Attorney George Gascón made the announcement, “We are not at this point ready to say that we either believe or do not believe that information, but we’re here to tell you is that we have a moral and an ethical obligation to review what is being presented to us and make a determination based on a resentencing side, whether they deserve to be resentenced.“

Variety now reports that Murphy, while isn’t interested in making a second season of Monsters, is willing to extend the series by an episode or two. He explains, “I think what I would be interested in doing, if Nicholas [Alexander Chavez] and Cooper [Koch] would agree to do it, is maybe one or two episodes that continue the story.” Now that a re-trial is being set, Murphy thinks the Menendez brothers may see the outside world again in 2025. He stated, “We gave them their moment in the court of public opinion. Basically, we did give them a platform. I think they can be out of prison by Christmas. I really believe that.”

Ironically, even with the kind of support that Murphy has generated with his show, Erik Menendez was critical of him and his brother’s portrayal and came out against the series. Murphy’s response to that was a somber one, “The thing that’s kind of painful is that the family was so outrageously against the show and spoke out so vociferously against it. But then the thing that they thought would hurt them is actually helping them. That doesn’t feel so great.” Erik Menendez responded to the show by saying,  “I believed we had moved beyond the lies and ruinous character portrayals of Lyle, creating a caricature of Lyle rooted in horrible and blatant likes rampant in the show. I can only believe they were done so on purpose. It is with a heavy heart that I say, I believe Ryan Murphy cannot be this naive and inaccurate about the facts of our lives so as to do this without bad intent.”

Ryan Murphy is no stranger to having to defend his works, especially when it comes down to real-life portrayals. With his latest venture, Monsters: The Lyle and Erik Menendez Story, taking some heat from Erik Menendez himself, Murphy has gone on the defensive yet again, saying the brothers should be thanking him for the series.

Speaking with The Hollywood Reporter amid Erik Menendez’s dismissal of the second season of Ryan Murphy’s anthology series, the creator stated, “I’ll tell you my thoughts about the Menendez brothers. The Menendez brothers should be sending me flowers. They haven’t had so much attention in 30 years. And it’s gotten the attention of not only this country, but all over the world. There’s sort of an outpouring of interest in their lives and in the case.” Murphy added that the outcome for the brothers has been nothing short of positive. “I know for a fact that many people have offered to help them because of the interest of my show and what we did. There is no world that we live in where the Menendez brothers or their wives or lawyers would say, ‘You know what, that was a wonderful, accurate depiction of our clients.’ That was never going to happen, and I wasn’t interested in that happening.”

Murphy would go on to say that critics – particularly the Menendez brothers and their team – are missing the point that the series isn’t just about them but also about the journalists and attorneys that played a key part in how the story was presented in the first place. With this, he said the brothers are yet again playing victim to the tune of “poor pitiful us.”

One of Erik Menendez’s key points in his take on Murphy’s series is that he is supporting a slanderous narrative that doesn’t properly take into account the abuse they went through. Reacting to this, Murphy stated, “I think they could have killed their parents, and also had been abused. They could have been of ambiguous moral character as young people, and be rehabilitated now. So I think that story is complicated…”

If you were around in the 90s then chances are you remember the Menendez Murders. Two brothers murdering their parents in cold blood is something you’d expect to read in the movie headlines yet this was real life in Beverly Hills. Their trial was one of many sensationalized trials at the time, with society being obsessed with Court TV. After Dahmer saw massive success for Netflix, Ryan Murphy decided to take aim at another popular trial (with Ed Gein being the subject for Season 3). And with the details a bit murkier this time around, Murphy takes the approach of having nearly every episode feature a different perspective/theory. This results in the show having a lot of conflicts in what actually happened, in the name of trying to tell all sides to the story. Our TV Critic Alex Maidy didn’t love the show but appreciated the performances.

I was fortunate enough to talk to the entire cast about Monsters: The Lyle and Erik Menendez Story. Javier Bardem and Chloe Sevigny got into some of the brutal accusations against the parents. Nathan Lane and Ari Graynor may have been enemies in the show, but they couldn’t be more welcoming in an interview setting. Cooper Koch and Nicholas Alexander Chavez discussed the fantastic fifth episode which sees Cooper in a nearly 35-minute take. And given that Erik Menendez has come out against the show, I had to ask Cooper which episode he would show Erik to get him on board for the show. Monsters: The Lyle and Erik Menendez Story has proven to be another big success for Netflix. However, just like the Jeffrey Dahmer season before it, the series is generating some controversy, including from one its subjects. Erik Menendez took to social media (through his wife Tammi) to slam Monsters co-creator Ryan Murphy for including “ruinous character portrayals” of both him and his brother.

While speaking with Entertainment Tonight, Murphy defended the show as he addressed Erik Menendez’s criticisms. “I think it’s interesting that he’s issued a statement without having seen the show,” Murphy said. “It’s really, really hard — if it’s your life — to see your life up on screen. The thing that I find interesting, that he doesn’t mention in his quote, is if you watch the show, I would say 60-65 percent of our show, in the scripts and in the film form, center around the abuse and what they claim happened to them. And we do it very carefully, and we give them their day in court, and they talk openly about it.

Murphy continued, “In this age where people can really talk about sexual abuse, talking about it and writing about it and writing about all points of view can be controversial. It’s a ‘Rashomon’ kind of approach [in Monsters], where there were four people involved in that — two of them are dead. What about the parents? We had an obligation as storytellers to also try and put in their perspective based on our research, which we did.

The show also includes suggestions that Erik and Lyle had a homoerotic and incestuous connection, which Murphy defended. “If you watch the show, what the show is doing is presenting the points of view and theories from so many people who were involved in the case,” Murphy said. “[Vanity Fair journalist] Dominick Dunne wrote several articles talking about that theory. We are presenting his point of view, just as we present [criminal defense attorney] Leslie Abramson’s point of view… and we had an obligation to show all of that and we did.

Somewhere in the annals of entertainment sayings, surely one must go something like: If you can make a killer think he’s the victim, you need not to any other press. But Erik Menendez – one half, along with fellow parent murderer and New York Knicks fan Lyle – of the Menendez Brothers has a serious problem with Ryan Murphy due to his depiction of them in his latest series, Monsters: The Lyle and Erik Menendez Story.

Erik Menendez – who, like older brother Lyle, is currently serving a life sentence – wrote the following statement, which was shared by his wife Tammi on social media: “I believed we had moved beyond the lies and ruinous character portrayals of Lyle, creating a caricature of Lyle rooted in horrible and blatant likes rampant in the show. I can only believe they were done so on purpose. It is with a heavy heart that I say, I believe Ryan Murphy cannot be this naive and inaccurate about the facts of our lives so as to do this without bad intent.” He added, “It is sad for me to know that Netflix’s dishonest portrayal of the tragedies surrounding our crime have taken the painful truths several steps backward — back through time to an era when the prosecution built a narrative on a belief system that males were not sexually abused, and that males experienced rape trauma differently than women. Those awful lies have been disrupted and exposed by countless brave victims over the last two decades who have broken through their personal shame and bravely spoken out. So now Murphy shapes his horrible narrative through vile and appalling character portrayals of Lyle and of me and disheartening slander.”

So, a couple of things here. First, we all know that what the Mendendez brothers did was heinous, acts of parricide that shocked the nation and rocked headlines in the ‘90s. But anyone presenting all of this in any form of media does have a responsibility to aim for the truth, even if some liberties are taken. Then again, Ryan Murphy isn’t exactly known for his subtlety or couth delivery, somehow even making larger-than-life figures such as Bette Davis and Truman Capote more of caricatures than we already knew them as. When you think about it, the Menendez brothers are just the latest target, whether you think Murphy intended harm or not. But the damage he has done (at least according to Erik Menendez) may have greater implications than ever.

Erik Menendez ended his statement by calling out Murphy for diminishing the effects of child abuse. “Let the truth stand as the truth. How demoralizing to know that one man with power can undermine decades of progress in shedding light on childhood trauma. Violence is never an answer, never a solution, and is always tragic. As such, I hope it is never forgotten that violence against a child creates a hundred horrendous and silent crime scenes darkly shadowed behind glitter and glamor and rarely exposed until tragedy penetrates everyone involved. To all those who have reached out and supported me. Thank you from the bottom of my heart.”

Murphy’s interpretation of the Mendenez brothers story isn’t the first time Ryan Murphy has faced criticism for his depiction of other real-life infamous killers, as the first season of Monster was accused of exploiting the murders of Jeffrey Dahmer in a way no one else in movies or TV had before.

PLOT: Monsters: The Lyle and Erik Menendez Story chronicles the case of the real-life brothers convicted in 1996 for the murders of their parents, José and Kitty Menéndez. While the prosecution argued they were seeking to inherit their family fortune, the brothers claimed – and remain adamant to this day, as they serve life sentences without the possibility of parole – that their actions stemmed out of fear from a lifetime of physical, emotional, and sexual abuse

REVIEW: The ever-expanding anthology series credited to super-producer Ryan Murphy continues to expand. Earlier this week, we shared our review for the newest American Story series, American Sports Story: Aaron Hernandez. While that series did not have Murphy directly involved as a writer or director, he does boast direct credits alongside longtime collaborator Ian Brennan on the second entry of Monster; this time focused on the tantalizing crimes of Lyle and Erik Menendez. One of several cases dubbed the Trial of the Century, the story of the Menendez siblings and the heinous murder of their parents has been adapted many times across multiple formats. Murphy and Brennan know the public may be familiar with the sordid details. Still, Monsters: The Lyle and Erik Menendez Story aims to outline the events for a new generation and shed multiple angles on the conflicting theories as to what really happened.

Told over nine episodes, Monsters is very similar to the Dahmer entry in the anthology but completely different simultaneously. Both series look at the inner psyche of people who committed atrocious acts of murder, but Dahmer felt almost nihilistic and brutally dark. Monsters paints Lyle and Erik Menendez in a comical light, giving this season a tone that is almost campy. There are multiple scenes in Monsters that I chuckled at. I immediately felt guilty laughing at a crime that is among the most disgusting in modern history. The bizarre series of events that led to the murders in Monsters are too strange to be true, and yet here we are watching a tale that is somehow weirder than Jeffrey Dahmer eating people. Nevertheless, had the Menendez brothers been fictional, they would have been right at home on American Horror Story. Since they actually exist, Monsters works as a forum to chronicle every seedy and odd aspect of the siblings’ crimes in a way that goes beyond the boundaries of the similarly-themed American Crime Story.

Taking the story from Lyle (Nicholas Alexander Chavez) and Erik (Cooper Koch) planning the shotgun deaths of Jose Menendez (Javier Bardem) and Kitty (Chloe Sevigny) to executing their parents through their failed first trial and subsequent second trial that led to life in prison, Monsters posits the claim that the two brothers committed their crimes because their father was sexually abusing them. Rather than claiming the truth of the accusation, Monsters shows us the various holes in the Menendez brother’s claims while allowing both Javier Bardem and Chloe Sevigny to play Jose and Kitty in various styles. In one claim, Bardem is over-the-top evil as an abusive and overbearing father, while Kitty is useless in a drug and alcohol-induced stupor. In other alibis, there are tweaks and changes to how Jose and Kitty actually were in public versus private situations, each altered by testimony from family and friends that assert and deny Lyle and Erik’s claims. Both Nicholas Alexander Chavez and Cooper Koch play their roles as pathological and sociological, leaving the audience unsure of whether they are telling the truth or not.

Monsters review

Spanning 1989 through 1996, the majority of Monsters is presented in a linear fashion with flashbacks, some true and some lies, that illustrate the calculating nature of Lyle and Erik. While the brothers command the screen the majority of the time with solid supporting performances from Bardem and Sevigny, there are also key roles for Nathan Lane as journalist Dominick Dunne, who chronicled the brothers for a Vanity Fair article, as well as Ari Graynor as defense attorney Leslie Abramson. Dallas Roberts and Leslie Grossman have key roles as Dr. Jerome Oziel and Judalon Smyth, along with several minor ensemble players from prior Murphy productions. The 1990s are encapsulated perfectly through pop culture cues like songs from Milli Vanilli and the parallel occurrence of the O.J. Simpson trial. As a look at a specific period in the late twentieth century, Monsters boasts better production values than it does engaging and consistent writing.

Monsters features eight writing credits from Ian Brennan and two from Ryan Murphy. Brennan has been a professional partner with Murphy, dating to Glee in 2009, followed by Scream Queens, The Politician, Hollywood, Ratched, Halston, and The Watcher. While Brennan scripted nine of the ten episodes of Dahmer (four with Murphy and four with David McMillan), his heavier presence on season two without Murphy seems to indicate the tonal shift this season. Brennan also directed an episode this season alongside returning helmers from Dahmer, including Paris Barclay and Carl Franklin, with new helmers Michael Uppenahl and Max Winkler. The writing and directing team this season are very focused on showcasing the different angles on the true events of how and why Lyle and Erik murdered their parents. Still, it wavers between a steadfast approach to telling the truth and the fabricated and overindulgent excess that comes across as blatantly trying to dramatize an already dramatic story for no reason other than sensationalism. Ryan Murphy and Ian Brennan have always been good at using sensationalism to drive a more layered story, but that does not work with the Monsters anthology as it does with American Crime Story.

With exceptional performances from Javier Bardem and Chloe Sevigny alongside decent lead turns by Nicholas Alexander Chavez and Cooper Koch, Monsters: The Lyle and Erik Menendez Story is a mixed bag of true crime and untrue crime, with the blurred line separating them hard to distinguish. Like Dahmer before it, Monsters feels overlong and overindulgent, and it should have been more focused on insights we did not already know. For a generation unfamiliar with the Menendez Murders, this series may be a shockingly new story. Still, for those who witnessed the media circus in the Nineties, it does not bring much new to the table. Like the brutal and graphic recreation of the murders themselves, Monsters succumbs to being too callous with the horrible crimes it is warning us about.

The ten-episode series Dahmer – Monster: The Jeffrey Dahmer Story (read our review HERE) was such a huge success for the Netflix streaming service back in 2022 that Netflix ordered two more seasons of the show from creators Ian Brennan and American Horror Story co-creator Ryan Murphy. Last year, it was announced that the second season would be titled Monsters: The Lyle and Erik Menendez Story – and we’re now just a few weeks away from the premiere date! Monsters is set to start streaming on September 19th, and today, a trailer has arrived online. The trailer can be seen in the embed above, depicting the brothers’ warped mentality as they celebrate their cold-blooded crime.
